(f. 240 v left blank). — 260 × 190 mm. — 21 lines per page. — Written surface 145 × 95 mm. — Quinions numbered in Arabic numerals. A false title makes the volume appear to be a commentary on Taḥāwī (f. 1). We can assume that this text is a commentary on the Muḫtaṣar of al-Ḫiraqī (BROCKELMANN (C), Geschichte der arabischen Literatur, Suppl. I, 311); it is not the Muġnī although many allusions to Ibn Qudāma are made throughout the bāb mīrāṯ al-muṭallaqa chapters (f. 3 v). first words: مخوف او غير مرض الموت طلاقا باينا قطع التوارث بينهما قال Some chapter titles bāb al-iqrār bimu?ārik fī l-mīrāṯ (5); bāb mīrāṯ al-qātil (9 v); bāb mīrāṯ al-muʿtaq (10); bāb al-walāʾ (11); faṣl fī ǧarr al-walāʾ (14); bāb al-ʿitq (15)... bāb al-ḥaḍāna (239) الحضانة مصدر حضنت المرأة ولدها حضانة و هي واجبة Exp. Un faux titre fait passer le volume pour un commentaire de Taḥāwī (f. 1). On the assumption that this text is a comment from Muḫtaṣar in Iraq (BROCKELMANN (C), Arabic Literature, Suppl. I, 311); This is not the case with the main allusions of Ibn Qudāma and his loved ones who have long lived in the house of Al-Muṭallaqa (f. 3 v). premiers mots: Fearful or other than illness, death is a clear divorce, severing the inheritance between them. The author, may God have mercy on him, said: If he divorces her during his health or illness, it is not quelques titres de chapitres bāb al-iqrār bimu?ārik fī l-mīrāṯ (5); bāb mīrāṯ al-qātil (9 v); bāb mīrāṯ al-muʿtaq (10); bāb al-walāʾ (11); faṣl fī ǧarr al-walāʾ (14); bāb al-ʿitq (15)... bāb al-ḥaḍāna (239) Because if he leaves it, he will be lost and perish, then it is obligatory to protect him from that. Custody is a source. A woman has custody of her child and it is obligatory Exp. (f. 240): The slave girl, for she has graduated, is known, and is of sound mind, so we do not fear for her, unlike Copie anonyme et non date, collationnée.
