Notes
It has been accepted by the majority that the unified news that expresses suspicion is better than the syllogism that is speculative. However, it seems that there is no consensus among the Maliki scholars who quoted from Imam Malik (d. 179/795) regarding his opinion on the subject. In addition, no narration from Imam Malik himself regarding the scientific and practical value of the unified news has survived to the present day. Again, there is no direct reference to the concept of "haber-i vâhid" in Muvatta. However, his thoughts about the news of unity could be reached based on the narrations that can be evaluated within the scope of news of unity. For the aforementioned reason, it is important to accurately determine his opinion about which one he presented in case of conflict between the news of unity and qiyas. He evaluated the unified news from a fiqh perspective and preferred those that conformed to his principles, and did not prefer those that did not. The fact that Imam Malik did not reject the news of unity that he did not act upon, and even narrated it, shows his sensitivity about the news of unity. As a matter of fact, although Imam Malik did not act on the hadith regarding the parliamentary discretion in shopping, he narrated it from Ibn Omar. Although Imam Malik gave priority to the marfu' hadith, in some cases he did not act with the marfu' hadith. In such cases, despite the marfu' hadith, giving a decision other than its ruling is his Hz. This does not mean that he does not care about the actual sunnah of the Prophet (pbuh). Imam Malik explained this by saying that there is no rule in him that requires the necessity of this hadith and there is no situation that has been acted upon. The predominant view of Imam Malik's qiyas and news attack is that the syllogism is not a terminological syllogism, but what is meant by this syllogism is the rules and principles that are generally valid everywhere. In the Maliki sect, three different views have emerged about which of the news of unity and qiyas should be preferred in cases where the news of unity attacks the qiyas and it is not possible to combine the two: 1. According to the 'Iraqiyyun scholars of the sect, when the news of the uniqueness attacks the qiyas, qiyas is presented to the news of unity. 2. According to the scholars of Civilization, when the unified news attacks the qiyas, the unified news is presented to the qiyas. 3. From Ulama, Abu Bakr Muhammad b. Abdullah b. According to Muhammed el-Ebherî (d. 375/986), Imam Malik preferred the definitive syllogism to the news of revelation. Imam Malik did not abandon the unified news except when it was contradicted by a certain source and not supported by another source, or when it attacked a certain source based on the principles deduced from the Quran or authentic hadiths. In this research, it has been tried to determine what Imam Malik's view is in the case of conflict between khabar al-wahid and qiyas, both from Maliki sources and other works. While doing this, the document analysis method was used. Again in this study, the definition of khabar al-wahid, its degrees and qiyas were defined, and the evidence of those who preferred khabar al-wahid to qiyas and the evidence of those who preferred qiyas to khabar al-wahid were examined.
