In the modern world, parties play an important role in civil society. The first condition of representative democracies is the existence of parties. Islamic societies are also more or less - voluntarily or involuntarily - accepting new phenomena such as parties. Theoretical discussions can provide the basis for proper entry of parties into Islamic countries. In the Islamic government, there are points of ambiguity both in the theoretical and religious bases and in the political and expert aspects of the parties. The theory of velayat al-faqih has countless applications, which, for example, shows its effects on political freedoms or the existence of parties and their limitations. The discussion of the parties can be followed at several levels. The first level is the sociological analysis of the parties. From the point of view of political sociology, parties have positive and negative effects. For example, regarding the Islamic Republic of Iran, it can be discussed what are the conditions and limitations on its way. Discussion at this level does not have a normative form. Parties may be studied at another level, from a normative point of view. Based on the belief that the theological-jurisprudential foundations of the party exist in Shia political thought (or Islam), this discussion can be raised in the form of ideas whether political jurisprudence or Shia political theology reflects such a phenomenon or not. The topics of this level in the dimension of political jurisprudence are both normative and first-rate. Political rhetoric may prepare the ground for political jurisprudence and is used in any way to prove religious propositions. The subject of this article is to examine the issue of parties at the third level. From this point of view, the case is mainly looked at from an external point of view. In fact, the purpose of compiling this article is not to deal with the issue of parties from the point of view of political sociology and political thought; Rather, the main goal is to determine the place of this debate in political thought and jurisprudence. It is obvious that the discussion of parties in the third level precedes the first and second level, because it has a methodological and secondary point of view.
