Notes
Since gold is a precious metal, it has been used in different ways in the past and today. Among its different uses, it has found its place mostly as money and jewelry. Naturally, raw gold must undergo certain processes in order to be used as money or jewellery. The workmanship processes of gold, a precious metal, are different from the production processes of other mines and goods. In our article, we will focus on the fact that the gold subject to production should be produced within the scope of the rules determined in fiqh, rather than the detailed and careful production processes of gold. Because gold is accepted as ribevi in the Sunnah and certain rules have been determined for its exchange. In the classical fiqh literature, these rules are evaluated within the scope of the contract of consumption. Accordingly, it was stated that the prices should be equal in the exchange of gold for gold. It should be appreciated that there is a difference between raw and processed gold in terms of labor and value. In gold-gold exchanges, the deficiency or excess between the prices due to workmanship must be evaluated fiqhically. In this context, in our article, we will discuss the issues of processing ribevi gold and paying wages to the craftsman for this workmanship in Islamic law of obligations; It was evaluated within the scope of the titles of shar, istisna' and salam. In addition, the fiqh provisions regarding the transactions of gold producing workshops are also among our titles.
