Notes Muhammad b. Îsâ b. There is not enough information in the sources about the life of İsmail el-Aksarâyî. As can be understood from his work called Nihâyeti's-sûl ve'l-emniyye fî teallümi a'mâli'l-fürûsiyye, he is an important Hanafi jurist. The author wrote the aforementioned book to explain the importance of jihad in general, to teach how to use war tools, horseback riding, and the legal rules that must be followed during and after war. Among the subjects he deals with are legal issues such as booty, captives, eman, musta'men, apostate, baghi, zimmet contract. Eman is a contract that guarantees immunity of life and property to non-Muslims who want to enter a country ruled by Muslims or surrender to an army of Muslims. According to Hanafis, the contract of trust is not binding since it is given considering the interests of Muslims. A person, whether a Muslim or a member of another religion, who enters a country other than his own for a temporary stay with safety and permission is called musta'min. Musta'men living in an Islamic country are under the protection and protection of the state as a requirement of the contract of trust signed with them. The protection and protection of the state provides them with security of life and property. For this reason, it cannot violate the rights of musta'men living in a Muslim country. In this study, we will discuss the eman and müste'men sections of İsmail el-Aksarâyî's work called Nihâyetü's-sûl ve'l-emniyye within the framework of the issues mentioned by the author in his book. For this reason, in matters deemed sufficient, no other sources will be used and the information given in the work will be sufficient.
