Insurance is a sector of the economy that has been around since the past and its importance is increasing day by day. The regulations introduced in insurance law should keep pace with developments in insurance law and be able to respond to needs. For this reason, systematic regulation of laws is very important. While Law No. 6762 was in effect regarding statutory provisions in Turkish law, it caused serious confusion in the insurance industry. However, the new Turkish Commercial Law No. 6102 (TTK) introduced a new insurance code. However, when dealing with the idea of revision, the legislature took the view that the old Turkish Commercial Code (TTK) was unable to address the needs. When changing the law, the legislature took into account the criticism of the old Turkish Commercial Code (TTK), while also closely examining comparative legal practices. In this context, the Insurance Contract Law (VersVG), which can be described as a reference regulation, is indirectly important for Turkish law. The most important point regarding insurance law is the legal meaning of insurance and the insurance contract, which forms the basis for everything. Although there are no major differences between Turkish legal doctrine and the definitions of insurance in comparative law, it is shown that there is complete uniformity between the definitions in terms of elements that change from application to application and are highlighted in the definition of insurance. In Austria, the Austrian insurance contract law is applied as a separate law, which has been in force since 1958 with various revisions and is based on the German insurance law. The above-mentioned regulation, as in Turkey, was not introduced as a component or code of the Commercial Law, but as a separate law. In this context, there are differences between the Austrian Insurance Contract (VersVG) and the Turkish Commercial Code (TTK) regarding the regulation of the law. These differences relate to the content of the law rather than whether an individual law has been passed. While the differences between the two legislative regulations were very large in the validity period of the old Turkish Commercial Code (TTK) numbered 6762, we see that this has been reduced as much as possible with the introduction of the new law numbered 6102, whereby the new legal regulation could be considered similar to the Austrian Insurance Contract (VersVG)., Türk Ticaret Kanunu (TTK) uzun yıllardır yürürlükte kalmış ve 6102 sayılı kanun ile yürürlükten kaldırılmıştır.
