Preventing people from exercising their right to petition to public authorities to make their voices heard is a violation of the freedom to seek justice. Preventing this violation requires punishing the action that damages the protected legal value. For this purpose, the Turkish Penal Code prohibits actions that hinder the exercise of the right to petition and imposes criminal sanctions on its violation. In this way, a Constitutional right is protected., Detention the enjoyment of right petition, which is recognized to reach out public authorities, appears as a violation of right to legal remedies. The prevention of this violation incurs that the acts harm protected legal interest are punished. For this purpose, Turkish Penal Code outlaws the acts inhibit the enjoyment of right petition and entails penalty to violation of whom. Thus a constitutional right is protected.
