Sample Text The crime of sterilization is regulated as two separate crime types in Article 101 of the Turkish Penal Code. According to the regulation in the first paragraph, sterilizing a man or woman without consent is a crime and requires a prison sentence of three to six years. If the perpetrator is a person who is not authorized to perform sterilization, this penalty is increased by one third. According to the second paragraph of the article, even if the sterilization is based on consent, if the sterilization is carried out by a person who does not have authority in this regard, a prison sentence of one to three years is imposed. In the crime in the second paragraph, the consent of the victim is a reason that increases the punishment, while in the crime in the first paragraph, the absence of consent is an element of the crime, and in the crime in the first paragraph, the fact that the perpetrator is an unauthorized person is a reason that increases the punishment. Although the Turkish Penal Code regulates sterilization as a crime, it does not regulate castration as a crime. In sterilization, a person's ability to reproduce is eliminated, and in castration, the ability to engage in sexual activity is eliminated. Although sterilization in Turkish law is regulated as a crime in the Turkish Penal Code (Article 101), lawful sterilization and other conditions and elements are regulated in the Law on Population Planning and the Regulation on the Execution and Supervision of Uterine Evacuation and Sterilization Services. Sterilization crimes protect the legal values of the individual's bodily immunity and reproductive rights, and are regulated as crimes that can be committed by anyone with general intent.
