| Sample Text | The legal struggle against the financing of terrorism gained a different importance after the September 11, 2001 attacks. The legal situation for Turkey, which is a party to many international agreements regarding the financing of terrorism and has made regulations in this regard in its laws, has become open to new discussions after the Law No. 5549 on the Prevention of Laundering Proceeds of Crime and the Regulation issued for the implementation of this Law. In this context, freezing people's assets through administrative decisions without a court decision may cause problems in terms of the rule of law and its reflection, the principle of certainty, and may violate people's property rights. The legal actions that have been taken against financing of terrorism have become more important after 9/11 attacks. In Turkey, which is one of the signatory states of several international conventions on fighting against financing terrorism and has made some legal arrangements on this issue, the legal situation has become more disputable after the enactment of Law No. 5549 on Prevention of Laundering Proceeds of Crime and its applicable regulation. In this context, the possibility to freeze the assets of those not by a court decision, but by an administrative decision could cause some problems related to rule of law and the principle of clarity and definiteness which is seen as a reflection thereof. Therefore, right to property of those involved could be violated. |
