The crime of depriving a person of liberty is regulated in Article 109 of the Turkish Penal Code No. 5237. It is a provision that brings together many types of crimes in the repealed Penal Code No. 765. People have full choice whether to stay in one place or go to another. Violation of this right is met with sanctions. The legislator has protected this right in the new Turkish Penal Code, as in the repealed Turkish Penal Code, and sanctioned its violation., Depriation of liberty is regulated in Article 109 of Turkish Criminal Code no. 5237 that gathered various crime type that were regulated in former Turkish Criminal Code no. 765. People have right to choose in terms of staying somewhere and going somewhere else. As it was referred in former Criminal Code, Turkish lawmaker protected this right under new Criminal Code and also imposed sanction for breaching it.
