| Sample Text | The analysis of possibilities is a huge part of the Shiite science of usul al-fiqh and was developed by Muhammad Bakir Behbahani (1706-1792 AD) and Shaykh Murtadaal Ansari (died 1864 AD). In doubtful cases, law often does not originate from actual principles induced from existing rules, but from procedural assumptions (usulamalia) that relate to a confirmed possibility. An example is the assumption of continuity: if one knows that a certain state of affairs, such as ritual purity, existed in some sense in the past, but has no evidence whether it still exists today, one can assume that the state has not changed. |
