The concept of fiqh disagreement, which has emerged since the early ages of Islam, continues its existence and vitality today. Particularly in the context of current issues, although disagreement has seemingly expressed differences, it has also served as a source of mercy and ease. Hz. The conflict that manifested itself among the companions during the time of the Prophet reached its peak with the emergence of sects that continued to exist in the following periods. Because the basic dynamic of different sects and schools is conflicting views on an issue. The conflict occurred within each sect after the formation process of the sects. This situation, which we will call intra-sectarian conflict, is essentially related to the different schools that emerged within the sect. The fiqh methods developed by each school depending on differences in geographical or scientific competence form the basis of this disagreement. The Maliki Sect can be mentioned as the most typical sect in which there is more than one tendency within a single sect. In this article, after briefly giving the conceptual framework and historical process of the concept of conflict, the phenomenon of "intra-sectarian disagreement" is explained in the Maliki Sect. We will try to reveal what kind of historical background it has in particular.
