Notes
This study was previously published in the 26th volume (2019) 1-2 of the journal Islamic Law and Society. This is the translation of the open access article titled “Khul‘: Local Contours of a Global Phenomenon” published in the issue of (https://doi.org/10.1163/15685195-02612P01). We thank the authors, Nadia Sonneveld and Erin Stiles, for permission to publish a translation of the article. This article examines the practices of hul, one of the Islamic divorce methods, in contemporary Muslim societies, and also focuses on the nature, legality and consequences of hul. The article started by explaining the basis of hul in the Quran and hadith literature, and then the practices in modern Muslim societies were explained. The application forms of Hul have been tried to be understood from the perspectives of both ordinary people and legal practitioners. As a result of the analysis carried out in the article, the main issues regarding hul have been identified and these have been addressed by adopting an approach that compares the understanding and use of hul in various cultural, religious and legal contexts in Asia, Africa and Europe.
