Islamic law (fiqh) is rich in sources. First of all, the Holy Bible, the Holy Quran, the Sunnah of the Holy Prophet, ijma (consensus on evidence) and reason/qiyas (analogy) form the basis of legal sources. On the other hand, the doctrines of Islamic scholars (ijtihads) are considered important sources of this right. These doctrines, which express different approaches to the dogma of religion, also played a special role in the formation of sects. A different view of verses and hadiths and its different interpretation from legal aspects has led to the study of religious law on the basis of more sects. One such doctrine is the rulings of Islamic scholars on khums (five). The phrase "one-half of the booty" in the 41st verse of "Anfal" surah has been interpreted differently by scholars, leading to the branching of ijtihads on this subject in two separate forms. This in itself has been the reason for the formation of the religious dogma in a different form and the appearance of different opinions and tendencies about khums in the literature of jurisprudence. We are of the opinion that the analytical analysis of the issue from the doctrinal point of view will contribute to scientific research and will be useful in the comparative study of sects.
