Notes
Issues related to the activity and procedure of ifta were included in the sections of the fürû-i fiqh works named edebü'l-fetvâ / âdâbü'l-müftî in the early periods, and in the following period, independent works with the same name were written. As the first independent works on this subject, İbnü's-Salâh Eş-Şehrezûrî's Edebü'l-müftî ve'l-müsteftî and İbn Hamdan's Sıfatü'l-müftî ve'l-müsteftî can be mentioned. Compared to other sects, independent works on the fatwa method in the Hanafi sect were written in a later period. As far as we can determine, the first independent Hanafi fatwa method work is Muhammed ed-Destinâî's treatise called Âdâbü'l-müftîn. IX. Only a single copy of this work, thought to have been written in the late (15th) century or early 10th (16th) century, has been identified. In the treatise consisting of four pages, the concept of fatwa and its derivatives, the etiquette and conditions of the mufti, and the etiquette of the mufti are included. In this article, the treatise named Âdâbü'l-müftîn, which is the first independent work of Hanafi fatwa method and about which there is not much information in the sources, and its author Muhammed ed-Destinâî will be introduced. In addition, the investigative text of this concise treatise will also be included with the idea of contributing to the literature on fatwa procedure.
