The noble advice of the Islamic religion emphasizes and encourages social solidarity and cooperation at every stage of life. From the encouraged advice; The Qur'an and hadith texts meticulously focused on the orphan and gave conditions and provisions for him to live a virtuous life. Islam aims to protect the orphan, shelter him, represent him, guarantee him, use his property correctly, and approach him with compassion and mercy. The texts of the Holy Quran and the Prophet. Muhammad (pbuh) appealed to the conscience of humanity and brought preventive and encouraging orders and prohibitions regarding the protection of the rights and laws of orphans. When it comes to caring for orphans and protecting their rights and laws, it is not a correct approach to understand them only as protecting and meeting their material needs. On the contrary, emphasis was placed on meeting his spiritual and psychological needs, not damaging his personality, and contributing to his growth as an individual useful to society. This issue is explained in the verse as follows: "Then do not crush the orphan" (Duha, 93/9). This command, embodied in the person of the Prophet, draws the attention of humanity to respect the material and spiritual rights of orphans. The main goal of the relevant texts is to prevent orphans from being left in the hands of abusers, to protect them and to provide an environment of love. Otherwise, orphans who are deprived of a loving environment may struggle with some psychological problems and pose problems for themselves and society. The main purpose of our study is to draw attention to the compliance with the rights of orphans in the axis of the Quran and hadith, according to the rapidly developing and changing living conditions of our age.
