Since the rules are limited and the events are unlimited, Islamic legal philosophy and logic come to the fore in many issues related to fiqh day by day. The study to be introduced here also addresses this issue. In this study, under the title of Islamic legal philosophy and logic, it is pointed out that the current provisions are the product of the past social environment and ways of thinking, and the relationship of the Arab society with revelation is examined. In this context, the aim of the study is to determine the effect of the human factor in the formation of the provisions in Islamic law and to draw attention to the necessity of distinguishing between the provisions related to the essence of revelation and the issues in which the human factor is effective. Thus, the claim to create a basis related to the essence of revelation in the reconstruction of fiqh constitutes the basic thesis of the study.
