Notes
In this work, the author discusses the source, application examples and transformation adventure of Ottoman Family Law, based on court records in different cities. It reflects the examples of the concrete side of Islamic family law, especially the practical applications of the Hanafi sect in the Ottoman Empire, reflected in the records. In general, the application has no problems with the opinions in fiqh sources. However, on some controversial issues, the views in the additional sources of the Hanafi sect have caused difficulties in practice. It has been announced that the state power sought solutions to eliminate troublesome situations by entering into action with laws, justice laws and edicts upon the request of Sheikh al-Islam. In addition to these records, the observations and notes of travelers, ambassadors and researchers who were in the Ottoman country regarding the application of Islamic Family Law were conveyed. Particular emphasis was placed on the parts that reflect contradictions. The subject is examined in the book in two parts: Ottoman Family Law in the Classical Period and Post-Tanzimat. It is stated that with the preparation of the Family Law Decree in the second chapter, a radical change was made in Islamic/Ottoman family law by including the views of four sects.
