Collection of fetāvā on the legislation of real estate, vaqf, “feudal” land (tımar.), rüsūm and jizifeh tax by various well-known Ottoman muftis, mainly sheykhülislams. In many cases the name of the source (mufti or fetāvā collection) is indicated after the answer. The book is divided into three sections (qiṭ‘a): 1. ijārāt al-mū’ajjal (ff. 7b-92a), 2. muqāta’āt al-mawqūf (ff. 92a-132b), 3. aḥkām-i arāżī-i mīrīye (ff. 132b-222a) and a khātime (ff. 222a-234b). The fihrist (ff. 1 b-7b) states this organization, but does not mention the contents of the following ff. 234b-277b, which contain laws (qānūn) on agricultural and grazing lands as well as agricultural taxes. There are numerous manuscripts of this work (cf. Türk. Hss. vol. 4, no. 92). The exp. of the Berlin ms. corresponds to the text of the present ms. on f. 234b! Judging from the lifetimes of the Sheykhülislams referred to (15th, 16th, 17th c.), parts of the material gathered in this collection date back to the 15th century. Götz, who mentions another copy in his Türk. Hss. vol. 5, no. 118, thinks that the collection was compiled in the 18th century on the evidence of a fetvā by Dürrī Meḥmed Efendi (Sheykhülislam in 1734-1736). However, since Shāṭirzāde Meḥmed ‘Ᾱrif (d. 1275/1858) had his work printed in 1836, it must have been written in the years immediately preceding this date. On ijāreteyn see also: Klaus Kreiser, ijāreteyn: zur ‘doppelten Miete’ im osmanischen Stiftungswesen. In: Journal of Turkish Studies10 (1986), pp. 219-226.
