Notes
Al-Jami’ Al-Saghir: Written by Muhammad bin Al-Hasan Al-Shaybani, a student of Abu Hanifa who died in the year 189 AH / 804 AD. The Book of Al-Jami’ Al-Saghir is a comprehensive book of the most important issues and their origins, and it contains additions to issues that were not mentioned in Al-Mabsut. It contains the benefit of the text on the authority of Abu Hanifa in every issue, and the number of issues in this book is one thousand five hundred and thirty-two. He mentioned disagreement in one hundred and seventy, and he did not mention analogy and approval except in two issues. It was said that it is the compilation of Abu Yusuf al-Qadi, but it was narrated by Muhammad on his authority. The correct view is that it is the compilation of Muhammad and in Kashf al-Zunun 562/1: Qadi Khan, who died in the year 592, said in his explanation of al-Jami’ al-Saghir: They differed regarding his work. Some of them said: It was written by Abu Yusuf and Muhammad, and some of them said it was written by Muhammad. When he finished compiling al-Mabsut, Abu Yusuf ordered him to compose a book and narrate from it, so he made it and did not arrange its issues, but Abu Abdullah al-Hasan ibn Ahmad arranged it. Al-Zafarani, the Hanafi jurist, who died approximately in the year 610. At the beginning of the publication: Muhammad ibn al-Hasan wrote a book on jurisprudence and called it al-Jami` al-Saghir, in which he collected forty books of jurisprudence and did not categorize the chapters in each book, as he had categorized the books of al-Mabsut. Then the imam judge Abu Tahir al-Dabbas classified it and arranged it to make it easier for the predecessors to memorize and study it. Then the jurist Ahmad ibn Abdullah ibn Mahmoud, his student, wrote it for him in Baghdad in his home and read it to him in the months of the year three hundred and twenty-two, and God knows best. The martyr Al-Sadr has an arrangement that will be described after this book. The copy ends with a chapter on the dead person being found in the house or in the camp.
Sample Text
After the basmala: Our master and master, Nasser al-Haqq and al-Din, Abu al-Qasim Ibn Yusuf al-Hasani al-Samarqandi, may God grant him peace, said: Our sheikhs used to venerate this book and say: No one should hold the position of judiciary and issue fatwas unless he memorizes the issues of this book... What is correct is that it was compiled by Muhammad and Sheikh Abu Abdullah Al-Zafarani, who classified its issues, arranged them in order, dropped the extras, and wrote out the benefits.
