Hz. Abu Bakr and Hz. An Analysis of the Factors Affecting Political Decision-Making in the Periods of Omar in Terms of Fiqh. In this research, the factors affecting political decision-making during the periods of Abu Bakr and Omar are discussed and these decisions are analyzed in terms of fiqh within the political context. Before this analysis, two issues are discussed; Firstly, the definition and characteristics of the political decision and the concept it corresponded to at that time were stated. In addition, the boundaries of the political area of that period were tried to be specified based on the property, the duties of the caliphate and the powers of the imam. Thus, the political decisions of that period and other actions of Abu Bakr and Omar were distinguished. As the second issue, the fiqh analysis of the political decision-making process of Abu Bakr and Omar was discussed. It has been determined that contemporary fiqh studies dealing with these political decisions deal with the subject under three parts of ijtihad. This classification has been evaluated as a fiqh analysis for the political decision process and the problems of this analysis, which is made without taking the political framework into consideration, have been tried to be revealed. Then, a new fiqh analysis of this process in the political context is presented, based on our finding that political decision is different from fiqh jurisprudence but is also connected to it in several ways. Analyzing the political decision-making process at that time contributed to the determination of the factors affecting the political decision, and in the study, these factors were divided into four: (1) reference and legitimacy, (2) personality of the decision maker, (3) people of the council, (4) surrounding conditions and maqasid al-shariah. Each of these factors has been analyzed through examples and an attempt has been made to reveal how the political and fiqh aspects are connected to each other.
Factors Influencing Political Decision Making at the Time of Abu Bakr Al-Siddiq and Omar Ibn Al-Khattab, and their Analysis from a Jurisprudential Perspective. This study deals with the factors influencing political decision-making at the time of Abu Bakr and Omar and analyzes them from a jurisprudential perspective. This analysis was preceded by two things: The first, is to determine what corresponds to the term political decision at the time of the study, based on several approaches, in addition to working to define the political field in that period based on the obligations of rulings, and powers of the imam identified by the jurists. Which distinguished the political and non-political decisions of Abu Bakr and Omar from in order to be able to analyze them. The second is the analysis the political decision-making process during that period from a jurisprudential perspective, representing the contemporary jurisprudence studies of these decisions under three chapters of ijtihad, and considered this classification a jurisprudential analysis from them of the decision-making process. This representation showed the problems of this analysis, which dealt with these decisions outside of their political framework. Then we presented another jurisprudential analysis of this process in its political context based on what we have reached of the distinction of Political Decision from jurisprudential ijtihad with its connection to it in several aspects. The analysis of the political decision-making process in that period contributed to identifying the factors influencing it, which we divided into four; Reference and legitimacy, the personality of the decision-maker, the people of Shura, the surrounding circumstances and the purposes and principles of Sharia. And we analyzed it through models of decisions in which each of these factors emerged, highlighting the political connection to the jurisprudence in each of them.
