One of the most important actors in today's commercial life, perhaps the most important, is commercial enterprises. For this reason, one of the most critical issues of commercial law is commercial enterprise and transfer of commercial enterprise. In this study prepared on the subject of "Defect in the Transfer of a Commercial Enterprise", the transfer of the commercial enterprise, which is specifically regulated both in the Turkish Commercial Code and the Turkish Code of Obligations, and in case the transferred commercial enterprise is defective, how the defect provisions regulated in the Turkish Code of Obligations will be applied and the consequences of the optional rights arising from the defect are examined. In this context, the sections of our study have been determined as "Transfer of the Commercial Enterprise", "Defect in the Context of the Transfer of the Commercial Enterprise" and "Optional Rights Arising from Defect in the Transfer of the Commercial Enterprise and the Consequences of the Use of These Rights" and the examination has been carried out in this way., One of the most important actors in today's commercial life, perhaps the most important, is commercial enterprises.
