Petroleum market activities cover the chain of activities covered in the Petroleum Market Law No. 5015, from procurement of crude oil domestically or abroad to its presentation to the user, either directly or through processing. Market activities in the law; It has been regulated that it refers to the import, export, refining, processing, storage, transmission, bunker delivery, transportation, distribution and dealership of petroleum. Petroleum market activities are activities carried out by private individuals within a competitive market structure by obtaining a license from the Energy Market Regulatory Authority and under the supervision and control of the Authority. Although market activities differ from private commercial activities in that they are subject to this public regime, they are not clearly regulated as public services.
In this context, in our thesis, oil market activities will be evaluated within the framework of the concept of public service. Our thesis study consists of three parts. In the first part, first of all, what oil is as an energy source, its place and importance in the global sense, the formation and development of the oil market in Turkey, and the market activities and who are the actors carrying out the activities will be explained. In the second part of our thesis, the concept of public service, which forms the framework of our study, the elements and types of public service and the basic principles of public service will be explained in detail. While examining these issues, relevant judicial decisions will also be discussed when appropriate.
The subject we really want to cover in our thesis will be in the third and last chapter. In this context, in the third chapter, the oil market activities within the scope of the Petroleum Market Law No. 5015 will be evaluated within the framework of the concept of public service. While making this evaluation, each element and principle of public service will be discussed separately, and an examination and evaluation will be made within the scope of the regulations in Law No. 5015, the regulatory will of the legislator, the secondary legislation provisions created by the Energy Market Regulatory Authority and the relevant judicial decisions., Petroleum market activities cover the chain of activities, which is regulated in the Petroleum Market Law No. 5015, from the domestic or international supply of crude oil to the presentation to the user, either directly or by processing.
