As it is known ECHR –as an instruments containing civil and political rights– does not include social rights. None the less since Airey v. Ireland case it has been accepted that “there is no water-tight division” separating economic and social rights from civil and political ones, and this approach has led to the development of a social rights jurisprudence within the ECHR case law. This paper deals with the protection of the right to health, a social right, in the context of ECHR case law relating to the right to respect for private and family life. By especially focusing on reproductive and environmental issues, it aims at indicating both contributions and also some risks of dealing with health issues under Article 8 of the Convention., Bilindiği üzere bir sosyal hak olan sağlık hakkı, kişisel ve siyasal hakları düzenleyen bir belge olan AİHS’te yer almaz. Bununla birlikte, Airey/İrlanda kararından bu yana Mahkeme ekonomik-sosyal haklar ile sivil-siyasal haklar alanında su geçirmez bir ayrım olmadığını kabul etmiş ve bu yaklaşım, AİHM içtihatlarında sosyal haklara ilişkin bir içtihat hukukunun gelişimine de yol vermiştir. Bu tebliğde, sosyal bir hak olan sağlık hakkı AİHM içtihatları çerçevesinde özel hayata ve aile hayatına saygının korunması hakkı bağlamında ele alınmaktadır. Böylece, özellikle üremeye ilişkin ve çevreyle ilgili sorunlar üzerinde odaklanılarak, Sözleşme’nin 8. maddesi çerçevesinde sağlık hakkını ele almanın sağladığı katkılara ve taşıdığı kimi risklere işaret etmek amaçlanmıştır.
