After the basmalah; Glory be to Him who has no argument stronger than his words. Then the poor servant says to the rich man, Ghanim bin Muhammad al-Baghdadi, “This is a treatise on the conflict of evidence that I collected for some of my brothers in the judiciary, and I called it the Refuge of Judges When Evidence Conflicts.” And if the issue was without apparent evidence, he agreed with the principles of our companions and acted upon them, and if he did not find a narration for it from its companions, and the later scholars agreed on something to act upon, and if they disagreed, he worked hard and issued fatwas with what was right in his opinion.
